General Terms of Use
This is a translation provided for convenience; the French version prevails in case of discrepancy. Read the French version.
1. Purpose
These terms govern the use of MIBS, an online marbles game playable in the browser, published by the person named in the legal notice (“we”, “us”). By playing MIBS, with or without an account, you accept these terms. Purchases are also governed by the general terms of sale, and your data by the privacy policy.
2. Access to the game
The game is free. All you need is a recent browser and an Internet connection; connection costs are your responsibility. We do our best to keep the game available at all times but cannot guarantee it: maintenance, updates or incidents may interrupt it, and the game’s content (modes, rules, items, balancing) changes over time.
3. Guest marble and account
- Guest marble: without signing up, your progress is tied to this device and this browser. Clearing the browser’s data erases it.
- Account: with a username and password, or with Google, your progress follows you across all your devices. Only one session can be open at a time.
- You are responsible for keeping your password confidential. An account is personal: it may not be sold, traded or lent.
- You can delete your account at any time from the game’s Account screen.
4. Nickname
Your nickname is visible to all players (games, leaderboards, public profile). It must not be insulting, hateful, sexual or discriminatory, nor use another person’s identity, a brand or personal contact details. A nickname reported by several players, or flagged by our filter, is replaced with “Player” for everyone; you can then choose another one.
5. Code of conduct
The following are prohibited:
- cheating: software, scripts or bots that play in your place, modifying the game or its communications with the server, deliberately exploiting a bug;
- creating multiple accounts, in particular to obtain referral rewards;
- harassing, threatening or pestering other players, including through repeated challenges or targeted nicknames;
- reporting players in bad faith;
- disrupting the service (deliberate overloading, attempted intrusion, circumventing technical limits).
6. Moderation and sanctions
In the event of a breach, we may, depending on its seriousness and in a proportionate manner: hide a nickname, remove winnings obtained irregularly, or suspend or delete an account. Except in an emergency or in cases of manifest abuse, we give reasons for the measure. You may challenge it by writing to the address given in the legal notice; we will then review the decision.
7. Marbles run by the game
So that every game feels lively at any hour, some marbles appearing in games and leaderboards are controlled by the game itself. They receive no rewards and have no effect on any prize.
8. Chalk, season points and virtual items
- Chalk and season points are earned by playing. They have no monetary value: they cannot be bought directly, traded, resold or converted into money.
- The game’s items (marbles, trails, effects, titles, emotes) are purely cosmetic: they give no advantage in play.
- Whether earned or purchased, they are granted to you as a personal right to use them in the game for as long as the game is operated; they do not constitute transferable property.
9. Liability
We take reasonable measures to protect the game and your data. We are not liable for any interruption caused by your equipment, your connection, an event of force majeure or a third party. Nothing in these terms limits the rights you have by law as a consumer.
10. End of the service
Should we have to shut down MIBS, we would announce it in the game at least 30 days in advance. Buyers’ rights would then be settled as provided in the terms of sale.
11. Changes to these terms
These terms may change as the game evolves. Any significant change is announced in the game before it takes effect. Continuing to play after that date constitutes acceptance of the new version.
12. Governing law
These terms are governed by French law. If you have a problem, please write to us first: most issues are resolved this way. For a dispute relating to a purchase, consumer mediation is available (see the terms of sale). Failing that, the competent courts are those determined by law.
